General Contest Rules

ARTICLE 1 – ORGANIZING COMPANY

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

These terms and conditions (which we will refer to as our “General Terms”) are the overarching general terms and conditions that apply to all the competitions promoted by Grease Pro (which we will refer to as Grease Pro, “we” or “us”). We refer to all these competitions as the “Competitions” or “Competition” in these General Terms. 

In addition to these General Terms, Competitions may also have their own specific terms and conditions (such as the details of how to enter, the opening/closing dates and the sort of prize you may win). Any such Competition-specific terms and conditions will be made available as part of the promotion of the particular Competition in publications and/or online. In these General Terms, we will refer to these Competition-specific terms and conditions as the “Contest-Specific Rules”. 

Grease Pro is a company registered in the United States with company number (850) 784-4433 You can contact us at this number if you have any concerns in relation to any of our Competitions, setting out clearly (i) the name of the Competition, (ii) the name of our publication or website running the Competition and (iii) your issue. 

Organizes from 06/28/2022 to 07/28/2022, these dates included, a giveaway free of charge and no purchase necessary, tentatively or definitively entitled “Trivia Contest Giveaway”, (hereinafter the “Trivia Contest”).

ARTICLE 2 – PRIZES

Winning Entrants will receive $25 in GP Cash added to their Grease Pro Loyalty Rewards account, which they can view online and redeem at any time. Redemption of GP Cash is subject to the provisions of the Loyalty Rewards Program Terms and Conditions which can be found on Grease Pro’s website.

There is no substitution, transfer, or cash equivalent for prizes, except that Grease Pro may, at its sole discretion and to the extent permitted by law, substitute prizes of comparable value. The prizes are expressly limited to the item(s) described in official Competition media and/or listed in the contest-specific rules and do not include taxes, gratuities or any other expenses. Any tickets awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets. Other restrictions may apply.

ARTICLE 3 – ELIGIBILITY

Competitions are only open to anyone age 18 or older, legally residing within the United States with an internet connection and a valid e-mail address (hereinafter the “Entrants”).

Employees of Organizing Company and any person who has directly or indirectly participated in the conception, the realization or the management of Competitions, including their spouses (marriage, civil union, common-law marriage), families’ members: ascendants and direct descendants or other relatives: household and non-household members are not eligible.

Grease Pro may at any time request from any Entrant to demonstrate compliance with the Rules and eligibility requirements set forth herein. Any Entrant who does not comply with the Rules and requirements set forth herein or who refuses to demonstrate compliance with such will be excluded from the Trivia Contest and will not be able, in case of prize award, to obtain it.

Only one entry per person is allowed. Should an Entrant enter multiple times, only their first entry will be taken into account. Entrants may participate as often as they like but if selected as a winner, may only win prize once per month. 

By participating in the Trivia Contest, the Entrant agrees to be fully unconditionally bound by these rules (the “Rules”). Entrants participating in the Trivia Contest must be Grease Pro Loyalty Rewards Program members to win.

ARTICLE 4 – ENTRY AND ENTRY METHODS

1. Entry: To participate in the Trivia Contest, Entrants must: Enter their answer to the weekly trivia question within a comment on the trivia question Facebook post. A Facebook comment on the trivia question post is required to be considered a valid entry.
2. Trivia Contest Mechanics: This Trivia Contest takes place exclusively online via the Grease Pro Facebook Page to be found at the following URL: https://www.facebook.com/GreaseProInc. During the Trivia Contest, a trivia question will be posted weekly. Entrants will have until 3 PM CST on the day the trivia question is published to enter their comment on the weekly Trivia Contest post. At or before 5 PM CST on the same day, a winner will be announced via a comment from Grease Pro on the Facebook post wherein the winner will be tagged.
3. Requirements for Participating in the Trivia Contest: Entries that are incomplete, fraudulent, automated or erroneous will be disqualified. Any Entry made contrary to the provisions of the Rules will render the entry invalid.

ARTICLE 5 – WINNER SELECTION AND NOTIFICATION

A totally random algorithm implemented on a third-party site will be used to instantly designate the Winning Entrants from the pool of all eligible Entrants. 

The Winning Entrant(s) (which we will refer to as “Winners”) will receive a message via Facebook Messenger from a Grease Pro representative [WITHIN 5 DAYS] notifying them of their win. 

Winner(s) must execute and return any required affidavit of eligibility and/or any required release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner(s) may be chosen. If a potential winner(s) cannot be contacted, fails to complete, sign and return any required affidavit or release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner(s) will be disqualified and will forfeit the prize. An entrant who provides a mobile wireless number to Grease Pro in connection with the Competition, including by entering via text message or providing a mobile number for winner notification purposes, is responsible for informing Grease Pro if his or her number is reassigned to another person at any time before the end of the Competition, and for providing an alternative number where he or she may be reached.

Unless otherwise specified in the prize notification,  all prizes or prize certificates may be picked up at the Grease Pro location specified for that Competition, and the winner(s) will forfeit any prize or prize certificate not claimed within fifteen (15) days of winning. Prize will be available for pick-up immediately upon being awarded, but in some cases, it may take up to five (5) days for that prize to be available, in which case the time allowed to claim that prize will be extended to twenty (20) days. Cash prizes may take up to fifteen (15) days to process, and winners of any cash contest will have forty-five (45) days to pick up their checks before they are forfeited. Prize or prize certificates will not be mailed to the winner(s) without the winner’s or winners’ prior written consent in which the winner(s) shall agree to assume its risk of loss. Grease Pro, its promotional partner(s) and/or sponsor(s) are not responsible for the safe arrival of a prize or prize certificate. Grease Pro reserves the right to substitute any prize for one of equal, or greater value.

ARTICLE 6 – CONDITIONS

Payments of all federal, state and local taxes are solely the responsibility of the winner(s). Winner(s) will be required to complete and submit an IRS Form W-9 or the equivalent including a winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Grease Pro in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.

Participating in the Competition and acceptance of a prize constitutes a winner’s and guest’s (where applicable) permission for Grease Pro or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Competition or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, Grease Pro may, where legal, require a winner (and guest or travel companion, where applicable) to sign a publicity release confirming such consent prior to acceptance of the prize. It is the responsibility of the winner(s) to ensure that their guest(s) or travel companion(s) sign and return any required release. In the case of a conflict in this paragraph 6-2 and any similar paragraph in contest-specific rules the general specific rules will govern.

To the fullest extent permitted by law, by participating in the Competition, you:

1. agree to grant Grease Pro a non-exclusive, perpetual, worldwide license to edit, telecast, exhibit, rerun, reproduce, use, syndicate, license, print, distribute and otherwise exploit any items (including any photos, videos, audio, or written material) submitted as part of your Competition entry (the “Materials”), or any portion thereof, in any manner and in any and all formats and media now known or hereafter devised, without payment to you or any third party;
2. acknowledge that Grease Pro reserves the right, in its sole discretion, not to use the Materials at all; and
3. represent and warrant that: you are at least as old as the age of majority in your state; you have the full legal right, power and authority to grant to Grease Pro the license provided for herein; you own or control the complete exhibition and other rights to the Materials you submitted for the purposes contemplated in this license; you are either the parent (or legal guardian) of any minor featured in the Materials or have received the express consent of the parent (or legal guardian) for any such minor to appear in the Materials and to enter the minor’s likeness in the Materials in the Competitions; and neither the Materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate any common law or any other right of, any person or entity.

Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Competitions, Grease Pro in its sole discretion may require verification of the Competitions winner’s or winners’ identification by a showing of valid government-issued photo identification.

To the fullest extent permitted by law, by participating and/or accepting a Prize, Entrants, winner(s) and guests (if applicable) agree to release and hold harmless Grease Pro, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, any social media platform utilized in the conduct of the Competitions (including but not limited to Facebook, Inc.) and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) against any and all claims or liability arising directly or indirectly from the prize or participation in the Competitions. Grease Pro may also require eligible winner(s) of the Competitions and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winner(s), guest(s) or travel companion(s) are under the age of majority in their state of residence), to sign a liability release confirming such consent. It is the responsibility of the winner(s) to ensure that their guest(s) or travel companion(s) sign and return any required release.

Grease Pro in its sole discretion, reserves the right to disqualify any person (and all of their entries) from the Competitions if he or she tampers with the entry process, the operation of the Competitions, or the operation of Grease Pro’s website, Facebook Page, and/or any other social networking site used in the Competitions, or is otherwise in violation of the rules. Grease Pro further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Competitions, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond Grease Pro’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competitions as determined by Grease Pro in is sole discretion. Any attempt by an entrant or any person to deliberately damage Grease Pro’s website, Facebook Page, and/or any other social networking site used in the Competitions or to undermine the legitimate operation of the Competitions may be a violation of criminal and civil laws. Should such an attempt be made, Grease Pro reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. Grease Pro’s failure to enforce any term of these General Terms shall not constitute a waiver of this provision. If due to circumstances beyond Grease Pro’s control, any competition or prize-related event or travel is delayed, rescheduled, postponed or canceled, Grease Pro reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Competitions and shall not be required to award a substitute prize.

The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Competitions, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Competition prize cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism or other factors beyond Grease Pro’s control.

To the fullest extent permitted by law, by participating in the Competition, you understand and agree that:

1. the Federal Arbitration Act applies to this agreement, and if the parties are unable to resolve their dispute amicably, it shall be resolved by means of binding arbitration (not in a court of law);
2. any and all disputes, claims, and causes of action arising out of or in connection with this Competition, or any prizes awarded, shall be resolved individually, without resort to any form of class action (even if the rules and procedures of the arbitration tribunal allow class arbitrations);
3. any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Competition, but in no event and under no circumstances will entrants or winners be permitted to obtain awards for attorneys’ fees, and you hereby waive all rights to claim punitive, incidental, or consequential damages, or any other form of damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased;
4. any claim or dispute regarding the Competition, these General Terms or the contest-specific rules, will be resolved pursuant to the laws of the State of Florida in which Grease Pro is located, without regard to the conflicts of laws and rules of that State or Commonwealth;
5. any claim or dispute regarding the Competition, these General Terms or the contest-specific rules will be resolved in a tribunal within the State or Commonwealth in which Grease Pro is located, and you submit to the jurisdiction of, and waive all objections to the jurisdiction or venue of, such tribunal;
6. if for any reason a claim or dispute regarding the Competition, these General Terms or the contest-specific rules proceeds in court rather than through arbitration, there will not be a jury trial.

The invalidity or unenforceability of any provision of these General Terms or the contest-specific rules, including but not limited to the agreement to arbitrate, shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, the General Terms and contest-specific rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

ARTICLE 7 – TERMS OF USE AND PRIVACY POLICY

By entering this Competition, you agree to be bound by these General Terms, the contest-specific rules (if any), and Grease Pro’s Terms of Use Agreement and to the use of your personal information as described in Grease Pro’s Privacy Policy. The Terms of Use Agreement and Privacy Policy can be found on Grease Pro’s website.
